Zuca Terms & Conditions
The following terms and conditions are issued by Zuca Limited (“ZUCA”) they will apply between you and zuca.co.nz when you use this website. By placing an order you are agreeing to accept these terms and conditions.

Zuca Limited reserves the right to change these terms and conditions at any time and without notice. It is your responsibility to regularly check these terms and conditions for any changes. If you do not agree with the terms and conditions set out below, you should not use this website.
1. General Information
- Your contract for purchases made through zuca.co.nz is with Zuca Limited and you undertake that all goods ordered by you are for your own private and domestic use only and not for resale. We provide no guarantees if our products are used in a commercial or public environment.
- You must be 18 years old to use this site. If you are under 18, you may only use this site with the agreement of and under the supervision of a parent or guardian. If you do not qualify, please do not use this site.
- You agree that email can be used as a long-distance means of communication.
- If you are registering, during the registration process, you must choose a username and password. You are responsible for all actions taken under that username and password and must only purchase from zuca.co.nz under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.
- If there are any changes to the details supplied by you it is your responsibility to inform zuca.co.nz as soon as possible.
- You undertake that all details you provide to zuca.co.nz for the purpose of ordering or purchasing goods or services are correct, that the credit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
- Zuca Limited reserve the right to terminate our agreement with you and to suspend or terminate your access to the site immediately and without notice to you if:
- You fail to make payment to us when due
- You breach any of our terms and conditions
- When requested by us to do so, you fail to provide within a reasonable time frame, enough information to let us check the accuracy and validity of any information supplied by you, or your identity.
2. Privacy Policy
Our privacy policy, sets out how we will use your information. By using this website, you consent to the processing described therein and warrant that all data provided by you is accurate.
3. Terms of Sale
By placing an order you are offering to purchase a product on and subject to our terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to the North Island and South Island of New Zealand and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery Charges notice for further information.
a. Our Contract
When you place an order, you will receive an acknowledgement email confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract will not be formed until we send you confirmation by email that the goods which you have ordered have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed.
b. Pricing and Availability
Whilst we try to ensure that all prices, details and descriptions on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
All prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.
c. Payment
We accept Master Card and Visa payments through our website. All payments via our website are processed using SSL (Secure Socket Layer) protocol, whereby sensitive information is encrypted to protect your privacy. All transactions are in New Zealand Dollars ($).

If the issuer of your credit card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
4. Delivery
Stock permitting, all orders are dispatched within two working days of being accepted. Please click here to view our Delivery Charges
Please be advised that we do not ship to PO Boxes or Private Bags.
We do not ship Internationally.

5. Returns
zuca.co.nz operates a 365-Day Return Policy in other words, 1 full year!
If you are not 100% satisfied with your purchase, you can return your purchase to our warehouse for an online store credit or full refund to the value of the products purchased, excluding delivery charges.
6. Liability
We do not accept liability for any errors and/or omissions contained in our website. We reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.
The products sold on zuca.co.nz are for private domestic and consumer use only. Accordingly, we do not accept liability for any direct loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the site or for any products or services purchased from zuca.co.nz
We have taken every measure to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers.
7. Indemnity
To the fullest extent permitted by law, Zuca Limited nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Zuca Limited or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.
While we endeavour to supply accurate information on this site, errors and omissions may occur. Zuca Limited does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on, or accessed, through this site.
Zuca Limited reserves the right to make changes to the content on this site at any time and without notice.

These terms and conditions are to be construed in accordance with the laws of New Zealand and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the New Zealand courts.
14. Entire Agreement
The above Terms and Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and ZUCA. Any waiver of any provision of the Terms and Conditions will be effective only if in writing and signed by a Director of ZUCA.
